Here is this other copyright thief who is still at it. http://comix-collection.blogspot.com/2008/04/arcor-doctor-sex.html
In order to get him off the web with his free downloads of material he stole from us, Google (which owns the system that his blog is on) requires an incredible amount of forms for the copyright owner to fill out and mail in. So if anyone has the time, please do this.
I will also do it as well, as soon as I have the time.

Jay, you could try emailing them and demanding that your stuff is removed. This info comes from their "Imprint" page. http://rapidshare.com/imprint.html

| I tried going through Rapidshare. They made the guy take some of my books down...but a month later he put them up again. If I gotta fill out forms every month to keep this stuff off the web, something is wrong with their system. The guy's page is anonymous. Rapidshare is fencing stolen goods.

Ultimately, of course, Rapidshare is responsible for the illegal sales (and even the illegal appearance) of your stuff on their site.
You could threaten to sue. And if you have any attorney friends, they could threaten to sue on your behalf. Sometimes that gets people's attention.
Rapidshare should be banning any user, anonymous or not, that is illegally uploading files. They can block the user's URL from accessing their services, etc. A good attorney could threaten to shut down their entire web operation, which may be partly legal.
They're based in Europe, though, aren't they? That may pose a problem.

Last January, Rapidshare lost a lawsuit in the German high court and the decision required them to take down everything and cease operations...in Germany, at least. I imagine they are appealing this...but in the interim, lots of copyright owners are getting screwed.
Also, what's to stop Rapidshare from setting up shop in Switzerland or some other country? Byrne Convention, where are you when we need you? Do they even HAVE an enforcement arm?

The Berne Convention was not designed to provide enforcement, but to establish international copyright law that could be enforced by local courts.

In other words, a team of lawyers (probably one in each country affected) is probably required to actually make the law effective. Gosh, that really helps artists, musicians and writers who have been victimized but barely earn enough money to pay the rent.
Of course, you could always contact the Comic Book Legal Defense Fund and see if they could help in some way or another.

CBLDF is more concerned with first ammendment issues. They have never dealt with disputes between artists and publishers or disputes between publishers and pirates. They primarily are watchdogs on free press, free speech issues. But the music industry and the Movie industry are on Rapidshare's case, I guess.

| Oooh, that's a good sign. Get the megabuck movie and music industries (and their litany of lawyers) on Rapidshare's tail and before long Rapidshare will only be sharing their rapid death. I hope that is the case, Jay.
