This is just cold... haven't even gotten a reply to my question from MHC. How do you put something up for auction, and then tell the customer that they get a refund because they really don't have it? IIRC I have to make a 'commit(ment) to buy' the comic when I hit the 'buy now' button, doesn't the seller have a commitment to sell?
 So not cool.
Dang right they do!!
They can either cough up your comic or give you something worth the same value...or preferably higher, for your inconvenience. Maybe something else that you have been looking for within a $5-$10 price range of that which you got cheated. That would be the classy thing to do.

I scored a page on ebay last night....
Marvel's John Carter, Warlord of Mars #19, last page (31). (John Carter is the guy with the funky headband in the top panel, btw)
By Ernie Colon & Frank Springer... One of my all time favorite series and the 1st comic I received by subscription. 
Think it does a good job capturing what the series is all about in a single page. The movie will be in theaters in 2012, with Williem Dafoe (Green Goblin) playing Tars Tarkas (another green skined character)
I'd really like a page from #18, bet those cost serious change, since it was done by Frank Miller.
Anyhow, with shipping -- $66.55

Apparently one of the employees put up a listing for vol.2 #3 instead of vol.3 #3... or something like that. The official reason given to eBay is 'ran out of stock'... so someone screwed up or MHC just needs to stop selling on eBay, 'cause I don't like buying something that may or may not be there.
